Fathers Child Custody and Visitation Rights

Many think that child visitation and child custody revolve around the rights of the mother and that the fathers rights are a secondary concern.  Visitation and child custody isn’t just about the mother’s rights. Fathers visitation rights are also crucial to child’s healthy life.  When a fathers visitation has been denied his rights have been violated.  It is important that he takes action to restore the relationship with his child.

Child Custody

Many people assume that primary custody of the child is automatically granted to the mother.  However, that is not the case.  Either parent may be granted primary custody of the child.  Parents can often time reach an agreement out of court as to where the child will live and who is the primary custodial parent.  The parents can also decide on visitation of the non-custodial parent.  It is often best when the parents can agree how they will co-parent the child together.  Parents that work together to find a visitation schedule that works for both of them and is in the best interest of the child often have less conflict in parenting.

However, in the absence of an agreement between the parents they can seek intervention in the courts.  The court will determine which parent will be the custodial parent and a visitation schedule for the non-custodial parent.

Visitation

Visitation is more and more often called parenting time.  When you think about it the father is not “visiting” their child during their time with the child but this is the fathers time to parent their child.  This time allows the child to deepen their relationship with the father.  It also allows the father to instill his values and morals in the child’s life.  It is healthier for the child to have a strong relationship with both parents except in extreme case where the child’ safety may be at risk.

Protect Your Rights

Fathers sometimes have their visitation schedules interrupted by an unforeseen event and both parents can agree on when parenting time will be made up.  However, other times visitation rights may be violated if the mother withholds the child from the non-custodial parent.

When the mother is withholding the child from the father the father may need to seek intervention by the courts to restore his visitation and even ask for make up time with the child.  It is also possible to negotiate with the mother outside of court to reach a new visitation agreement.  However, this new agreement will not be enforceable until a judge signs a new order.  It may be necessary to seek legal guidance to assist you choosing the right legal strategy to resolve your situation.
